Terms of
Service
These terms are the deal between you and Crate Creatives LLC ("we", "us") when you use tabletoptrivia.party, the game screens, the phone pages, the host console, the pack builder and the arcade (together, "TableTop Trivia" or "the service"). By joining a game, opening a room, creating an account or using any page here, you agree to them. If you do not agree, do not use the service.
1. What TableTop Trivia is
A trivia game for venues and groups. A host opens a room and puts the big screen on a TV. Players join from their own phones with a room code. Questions, mini-games, a bet question and a final wager score points. Points are the whole game.
2. Points only. No money, no gambling.
Every "chip", "bet", "wager", "stake" and "prize" in TableTop Trivia is game points with no cash value. Points cannot be bought, sold, cashed out, transferred or exchanged for anything. We never take money from players, hold money for anyone, or pay anything out. TableTop Trivia is not a gambling, sweepstakes, lottery or wagering service and must not be used as one.
A venue or host may run their own promotions around a night (a free drink for first place, for example). That is the venue's promotion, under the venue's own responsibility and local law. We are not a party to it and we do not administer, fund or guarantee it.
3. Who may use it
- You must be at least 13 to use the service and at least 18 to create an account or host a room. Many venues are 21+; the venue's rules apply at the venue.
- Guests play without an account. An account needs only an email address.
- Hosts are licensed by us. We may add, pause or remove a host at any time.
4. Your name, your face, your content
You choose a display name and may draw a face for your avatar. Hosts may write and upload question packs, images, audio and video. Everything you add is yours. You give us a worldwide, royalty-free licence to store, show and play it inside the service (on the room's screens and phones, on your player card, in the pack builder and library) for as long as it is there, and to keep it in backups for a short time after it is removed.
You promise that what you add is yours to use, is not illegal, hateful, harassing, sexual, violent or otherwise unfit for a room of strangers, and does not pretend to be someone else. Hosts can hide a face or remove a player from a room at any time, and we can remove any content or account that breaks these rules without notice.
Question packs you share with other hosts stay yours; sharing gives those hosts a licence to run the pack in their rooms.
5. Accounts
We sign you in with a link sent to your email. No passwords. Keep your email account safe: anyone who can read it can sign in as you. Tell us at hello@tabletoptrivia.party if you think your account is misused. You can delete your account at any time from your card page; stats, badges and friends go with it.
6. Fair play
Play from your own phone, as yourself. Do not automate play, send forged messages to the room, scrape the service, probe it for weaknesses, overload it, or interfere with other players, hosts or venues. We may remove players, void questions, end rounds, close rooms and suspend accounts to keep a night fair, and our calls on scoring are final.
7. Third-party names and trademarks
Trivia questions mention films, teams, brands, people and places. Those names and marks belong to their owners. TableTop Trivia is not affiliated with, endorsed by or sponsored by any of them. "TableTop Trivia" and the TableTop Trivia logo are ours.
8. Our content and code
The service, its design, code, artwork, built-in packs, badges and text are owned by Crate Creatives LLC or its licensors and protected by copyright and other laws. You may use the service as offered. You may not copy, resell, rebrand, reverse engineer or build a competing product from it, except where the law lets you regardless of this clause.
9. Availability and changes
The service is provided "as is" and "as available". We do not promise it will be uninterrupted, error-free or kept the same. We change features, scoring and games often, and we may stop the service or any part of it at any time. We may update these terms; the date at the top moves when we do, and continuing to use the service after that means you accept the new terms.
10. No warranties, limited liability
To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from the service. Our total liability to you for any claim is limited to one hundred US dollars (USD 100) or the amount you paid us in the twelve months before the claim, whichever is greater. Some places do not allow these limits; there, they apply as far as the law permits.
11. Your responsibility to us
If your content, your hosting of a night, your venue promotion or your breach of these terms leads to a claim against us, you will defend us and cover our costs and damages from it.
12. Governing law
These terms are governed by the laws of the State of Missouri, USA, without regard to conflict-of-law rules. Disputes go to the state or federal courts in Missouri, and you agree to their jurisdiction. If a clause is unenforceable, the rest stand.
13. Copyright complaints
If you believe content in the service infringes your copyright, email hello@tabletoptrivia.party with the work, where it appears, your contact details and a statement that you believe in good faith the use is unauthorised. We remove infringing content and may close repeat infringers' accounts.
